PARTICIPANT WAIVER AND RELEASE OF LIABILITY

In consideration of the opportunity to use the Bahama Golf’s (“Company”) building, golf simulator, and related equipment and components, I hereby agree to the following.

 

Participant Waiver and Release of Liability (“Agreement”).

My participation and use of the building, golf simulator, and related equipment is voluntary and subjects me to the possibility of physical injury, which could be minimal, serious, and/or result in death and loss of or damage to personal property (collectively, “Risks”). It is also reasonably foreseeable that my careless or reckless use of the building, golf simulator, and related equipment could result in personal injury or damage to personal property.

 

Accordingly, I agree tothe following terms, which apply in the present and in the future.

1. I hereby assume all of the risks for myself and any minor that I am responsible for
regarding the participation in any and all activities associated with the building, golf simulator, and related equipment and components, including by way of example, any risks that may arise from negligence or carelessness on the part of any person and from dangerous or defective equipment or property owned, maintained, or controlled by any person.

2. I hereby release and hold harmless the Company, its owners, employees, agents,
volunteers, contractors, any individuals associated with the Company (collectively, “Releasees”) from any claims, demands, losses, liability, damages, and attorney fees and costs whatsoever arising from, related to, or resulting from these Risks (collectively “Claims”), including those caused by the negligent acts or omissions of any or all of the Releasees.

3. I recognize the physical exertion involved in the use of the building, golf simulator, and related equipment, and attest and certify that I am physically fit to participate safely, and I have not been advised otherwise by a health care professional.

4. I will be personally liable for any and all damage to the building, golf simulator, and
related equipment caused by my conduct or actions.

5. This Agreement contains the entire understanding between and among the parties
concerning these matters. No waiver, modification, or amendment of any of the terms of this Agreement shall be effective unless made in writing and signed by the party to be charged.

I warrant that I have read and understood that this Agreement involves my waiver and release of rights and my assumption of responsibilities in participating in the events described in the Agreement.
